Attorney General Madigan:
I urge you to join the twelve other Attorneys General who are filing legal challenges to the federal health care legislation.
This legislation is an assault against the U.S. and Illinois constitutions. Proponents of the bill are wrongly using the Commerce Clause of the U.S. Constitution to justify the bill's individual health care mandate — which is nothing more than a penalty for simply being alive.
As Virginia Attorney General Ken Cuccinelli told Reuters last night: "If a person decides not to buy health insurance, that person by definition is not engaging in commerce ... If you are not engaging in commerce, how can the federal government regulate you?"
Attorney General Cuccinelli is correct.
Never before has the federal government required Americans to purchase any good or service as a condition of U.S. residency.
I ask that you, on behalf of the citizens of Illinois, join in these legal actions to represent the interests of Illinois citizens.
